Prenuptial Agreement in Las Vegas: Calm Prep, Signed at Home
The ring is on. The venue is booked. And somewhere between the cake tasting and the seating chart, one of you finally says it out loud: “Should we put something in writing?”
It can feel unromantic. It can even feel like a test. But for many couples, that conversation turns out to be one of the most honest they have before the wedding: about the house one of you already owns, the business you built, the children from a first marriage, or the debt nobody wanted to bring up.
Once you two have talked it through and know what you want the paper to say, the last thing you want is a waiting room and a weekday appointment you both have to take off work for. That is where we come in. We prepare the document you direct us to prepare, and our notary comes to you.
Ready to get your agreement on paper? Call 725-243-5188 and we will find a time that works for both of you, including evenings and weekends.
What is a prenuptial agreement under Nevada law?
Nevada law calls it a “premarital agreement.” The rules are in NRS Chapter 123A, Nevada’s version of the Uniform Premarital Agreement Act. The statute defines a premarital agreement as an agreement between prospective spouses made in contemplation of marriage and to be effective upon marriage.
Under NRS 123A.060, a premarital agreement becomes effective upon marriage.
What can a Nevada premarital agreement cover?
NRS 123A.050 lists the subjects that prospective spouses may contract about. In general terms, they include:
Each person’s rights in property belonging to either or both of them, whenever and wherever it was acquired
The right to buy, sell, use, transfer, lease, mortgage, or otherwise manage and control property
What happens to property upon separation, divorce, death, or another event
Changing or eliminating alimony or spousal support
Making a will, trust, or other arrangement to carry out the agreement
Ownership of the death benefit from a life insurance policy
Which state’s law governs the agreement
Other matters, including personal rights and obligations, that do not violate public policy or a criminal statute
The same section also states that a child’s right to support may not be adversely affected by a premarital agreement.
Which of these topics belong in your agreement, and what any term would mean for your situation, are legal questions. We do not answer them. A licensed Nevada attorney does, and many couples choose to have each partner’s own attorney review the draft before signing.
What does Nevada law say about signing a prenup?
NRS 123A.040 states that a premarital agreement must be in writing and signed by both parties, and that it is enforceable without consideration. After the marriage, NRS 123A.070 states that the agreement may be amended or revoked only by a written agreement signed by both spouses.
Chapter 123A’s formalities section does not mention notarization. Even so, many couples choose to have their signatures notarized, because a notarial certificate creates a record that each signer personally appeared and was identified on a specific date.
Why timing and disclosure come up so often
NRS 123A.080 describes circumstances in which a premarital agreement is not enforceable, such as when a party did not sign voluntarily, when the agreement was unconscionable when it was signed, or when certain conditions about financial disclosure are met. How that section could apply to any particular agreement is a question for a Nevada attorney. It is also a big reason many couples prefer not to sign in a rush the night before the ceremony.
How our prenuptial agreement document preparation works
Our prenuptial agreement preparation in Las Vegas is built for couples who have already reached their own decisions and want them organized clearly and signed properly. Here is how it usually goes:
One call with both of you. Call 725-243-5188. We walk through the process and what information we will ask you to provide.
You direct the terms. You tell us what the two of you have agreed to, and you provide the financial information you want listed in the disclosure schedules. We prepare the document you direct us to prepare.
You review the draft. Take your time. If you choose, each of you can bring the draft to your own Nevada attorney before you sign.
We come to you for the signing. Our notary meets you at home, at work, or anywhere convenient across the Las Vegas Valley, and notarizes your signatures.
What to have ready on signing day
Nevada notary law, NRS 240.155, says a notary may not notarize a signature unless the person is in the notary’s presence and is either known to the notary or identified by a credible witness or documentary evidence of identification. In practice, each signer should bring a government-issued photo ID with a signature, such as a driver’s license or passport.
It also helps to know what a notary does and does not do. Under NRS 240.075, a notary may not influence a person to enter or not enter into a lawful transaction involving a notarial act. Our notary is there to identify each signer and witness the signatures, not to weigh in on the terms. If the two of you cannot be together at the same time, ask us about separate signing appointments.

Prenuptial agreement FAQ
Does a prenuptial agreement have to be notarized in Nevada?
NRS 123A.040 requires a premarital agreement to be in writing and signed by both parties. That section does not list notarization as a requirement. Many couples have their signatures notarized anyway to create a record of who signed and when. Questions about whether a specific agreement needs anything more belong with a licensed Nevada attorney.
When does a prenup take effect in Nevada?
Under NRS 123A.060, a premarital agreement becomes effective upon marriage.
Can a prenup be changed after the wedding?
Under NRS 123A.070, after marriage a premarital agreement may be amended or revoked only by a written agreement signed by both parties.
Can Signature on Demand tell us what to put in our prenup?
No. We are a Nevada-registered document preparation service, not a law firm. We prepare the document you direct us to prepare, and our notary notarizes your signatures. For advice about terms, rights, or enforceability, consult a licensed Nevada attorney.
