Joint petition for divorce under NRS 125.181

Nevada allows spouses who agree on every term to dissolve their marriage by a summary proceeding, a joint petition, under NRS 125.181 to 125.184. The statute applies when, among other conditions, either party has met the jurisdictional requirements of NRS 125.020, the spouses have lived separate and apart for one year without cohabitation or they are incompatible, and there are no minor children or the parties have executed an agreement as to the custody and support of the children. NRS 125.020 requires that at least one spouse has resided six weeks in the State before suit was brought.

What a joint petition requires

Both spouses want the divorce and sign the petition
At least one spouse has lived in Nevada for six weeks before filing (NRS 125.020), confirmed by a resident witness affidavit
Agreement on the division of all community property and debts
Agreement on custody, visitation and child support for any minor children
Agreement on spousal support, if any, or a waiver
Valid photo ID for each spouse at signing

From consultation to decree

Free consultation. By phone or video. We confirm the case is uncontested, explain the documents and the court process, and quote the total.
Agreement, payment and intake. We send the service agreement and invoice, and the divorce intake form for the terms you have agreed on. Preparation begins once both are complete.
Preparation and review. We prepare the full packet, usually within three to five business days, and send drafts by secure email. Both spouses review and tell us about any corrections.
Signing and notarization. Both spouses sign before our notary, with our mobile notary at your location or by remote online notarization.
Filing. We file the packet with the Clark County Family Court and pay the filing fee. The court reviews a joint petition without a hearing in most cases and issues the decree; we deliver the file-stamped decree to you.

Divorce document questions

Do I need an attorney for an uncontested divorce? A document preparation service registered under NRS Chapter 240A may prepare the joint petition at both spouses' direction. Whether the terms you have agreed on are in your interest is a legal question; either spouse may have an attorney review the drafts.

What if my spouse will not agree? Then the case is not a joint petition. The $1,200 package prepares, files and serves a complaint for divorce for one spouse; from there the case proceeds under the court's rules, and contested issues require an attorney.

How long does it take? Drafts in three to five business days after complete information and payment. After filing, the court's review time for a joint petition is set by the court, not by us.

Is the court filing fee included? Yes. The Eighth Judicial District Court filing fee is included in each divorce package price above.

What is a QDRO? A Qualified Domestic Relations Order is the order a retirement plan administrator needs to divide a 401(k), pension or similar plan as the decree provides. It is prepared separately, $450, when a plan is being divided.

Do you prepare the deed if the house changes hands? Yes. A quitclaim deed transferring one spouse's interest as the decree provides is prepared and recorded separately. Updated estate documents, such as a will or power of attorney, are prepared at your direction.
