How Small Claims Court Works in Clark County
Nevada's small claims procedure is set out in NRS Chapter 73. Under NRS 73.010, a justice court may hear a small claims action "for the recovery of money only, where the amount claimed does not exceed $10,000." NRS 73.010(2) requires the case to be filed in the township where the defendant "is a resident, does business or is employed" — Clark County has eleven, including Las Vegas, Henderson, and North Las Vegas — and the plaintiff appears in person at the hearing.
Filing a case means getting the paperwork exactly right: the affidavit of complaint in the court's form, the correct filing fee, service on each defendant within the court's deadline, and a filed proof of service. Small claims filing fees are set by NRS 4.060 and published by the Las Vegas Justice Court: $66 if the sum claimed does not exceed $1,000; $86 if it exceeds $1,000 but not $2,500; $106 if it exceeds $2,500 but not $5,000; $146 if it exceeds $5,000 but not $7,500; and $196 if it exceeds $7,500 but not $10,000. The fee is paid to the court when the complaint is filed. No fee is charged to a defendant who appears in response to a small claims affidavit.
Service by the Constable or a private process server is a separate charge paid to the server. A defendant must be served no later than 14 days before the hearing, and the proof of service filed with the court at least 10 days before the hearing, per the Clark County Justice Courts' small claims instructions.
From Demand Letter to Court Date
1. Free consultation. You describe the dispute and the amount. We explain which documents your township requires and quote the court and service fees.
2. Demand letter. We prepare and mail the certified demand letter and give you the tracking. Where your township requires a demand before filing, you wait the period it specifies before proceeding.
3. Complaint package. We prepare the Affidavit of Complaint and attachments, organized and ready to file.
4. Filing. You file with your township's justice court and pay the filing fee, or we file with you at your direction.
5. Service and proof. We coordinate service on each defendant and prepare the Proof of Service for filing before the deadline.
6. Hearing. You appear and present your case. Bring the documents we organized for you.

What we do not do: give legal advice or opinions, tell you whether you have a case or your chances of winning, choose or evaluate your evidence, appear with you in court or at mediation, or predict outcomes. NRS 240A.240 prohibits a document preparation service from promising a result "unless the registrant has some basis in fact for making the promise." Small Claims Questions
Can you tell me if I have a good case? No. We cannot assess the merits of a claim or give legal opinions. We prepare documents from the information you provide; a Nevada attorney can evaluate the claim itself.
Will you come to court with me? No. Small claims plaintiffs represent themselves at the hearing. We prepare and organize the paperwork so you arrive with everything the court expects.
What if my claim is more than $10,000? NRS 73.010 limits small claims to claims for the recovery of money only, where the amount claimed does not exceed $10,000. A larger claim is filed as a regular civil action in justice court (up to $15,000) or district court; we prepare those pleadings as well, quoted separately.
Can a business file in small claims? Yes. A business owner or an authorized employee may file and appear for the business in small claims. We prepare the documents in the business's name at the direction of the person authorized to act for it.
How long does it take? Preparation of the demand letter or complaint is usually complete within two to three business days of receiving your information and payment. The court sets the hearing date when the complaint is filed.
Do I need a lawyer for small claims in Las Vegas? Small claims is designed for self-represented parties, and you appear on your own behalf. What you may want is help getting the paperwork right, which is what a registered document preparation service does.
