Living Trust Document Preparation
Las Vegas, Nevada

Signature on Demand provides revocable living trust document preparation services in Las Vegas, Nevada. A living trust allows assets to pass directly to beneficiaries without probate court proceedings. Document preparation services are available for single and married couple revocable living trusts, including pour-over wills and supporting documents. Services are provided by a registered Nevada Document Preparer — not an attorney. Nevada Document Preparer License #NVDP20239116529.

What a living trust is under Nevada law

A revocable living trust is a written arrangement in which you, as settlor, transfer title to property to yourself as trustee, to be held and distributed under instructions you write, with a successor trustee named to take over at incapacity or death. NRS 163.002 provides that a trust may be created by a declaration by the owner of property that he or she or another person holds the property as trustee, and NRS 163.004 states that the terms of a trust instrument may expand, restrict, eliminate or otherwise vary the rights and interests of beneficiaries in any manner that is not illegal or against public policy.

Property titled in the trust at death is administered by the successor trustee under the trust's terms rather than by the probate court. Property that is not titled in the trust passes under the will and Nevada's probate procedures, including the simplified small-estate procedures in NRS 146.070 and 146.080 where they apply. A trust instrument is not filed with the court; only the deed and, when needed, the certificate of trust become public. Signature on Demand prepares the complete trust package at your direction under NRS Chapter 240A. We do not advise whether a trust suits your circumstances, or on tax, creditor, Medicaid or family-law questions; a Nevada attorney can, and you are welcome to have one review any document we prepare.

Nevada living trust packages in Las Vegas

Six documents, prepared as one set. Each package includes preparation and recording of one deed for one Nevada property.

  • Single-person living trust package, $850. Revocable living trust, certificate of trust, pour-over will, durable financial power of attorney, health care power of attorney, and one deed to trustee recorded with the Clark County Recorder.

  • Two-person living trust package, $1,325. Joint revocable living trust, certificate of trust, two pour-over wills, two durable financial and two health care powers of attorney, and one deed to trustee recorded with the Clark County Recorder.

Each additional property deed is $250. A special-needs trust article and DMV title transfers into the trust are quoted at the consultation. County recording fees are paid to the Recorder; no Real Property Transfer Tax is due on a deed into your own trust when a certificate of trust is presented (NRS 375.090(7)). Notary fees follow the Nevada schedule and are billed separately. See the full fee schedule.

What each document in the package does

  • Revocable living trust. The trust instrument naming the settlors, trustees, successor trustees, beneficiaries and the distribution instructions you specify. Revocable means you can amend or revoke it while you have capacity.

  • Certificate of trust. A short document banks, title companies and the county recorder use to confirm the trust without seeing its full contents. NRS 164.410 lists what it may confirm, including the existence of the trust and date of execution, the identity of the settlor and each currently acting trustee, and the powers of the trustee.

  • Pour-over will. Directs any property not titled in the trust at death into the trust. Signed before two witnesses (NRS 133.040) with a notarized self-proving affidavit (NRS 133.050). See also our will preparation service.

  • Durable financial power of attorney. On the Nevada statutory form (NRS 162A.620). Under NRS 162A.210 a Nevada power of attorney is durable unless it expressly provides that it is terminated by the incapacity of the principal. See power of attorney preparation.

  • Health care power of attorney. Names the person who makes medical decisions for you if you cannot (NRS 162A.700 to 162A.870); signed before a notary or two witnesses under NRS 162A.790.

  • Deed to trustee. Transfers your Nevada home into the trust and is recorded with the Clark County Recorder. A trust controls only property titled in it, which is why the deed is part of the package rather than an add-on. See deed preparation.

How the trust package is prepared

  1. Free consultation. By phone, video, or in person by appointment. We explain the documents and the steps and answer procedural questions so you can decide whether to move forward.

  2. Agreement, payment and intake. When you are ready, we send the service agreement and invoice and our trust intake form for names, property and distribution instructions. Preparation begins once both are complete.

  3. Preparation and review. We prepare the full package, usually within two to three business days of complete information, and deliver drafts by secure email. You review and tell us about any corrections.

  4. Signing. A separate appointment: the trust, powers of attorney and deed are notarized and the will is witnessed, with our mobile notary at your home, office or facility anywhere in the Las Vegas valley, or by remote online notarization. We arrange witnesses on request.

  5. Recording and delivery. We record the deed with the Clark County Recorder and deliver your executed set with funding instructions for accounts you choose to retitle.

Living trust questions

Do I need an attorney to create a Nevada living trust? A document preparation service registered under NRS Chapter 240A may prepare the trust package at your direction. Whether a trust is the right instrument for your circumstances, and any tax, creditor or Medicaid question, is a legal question for a Nevada attorney. Many customers have an attorney review the drafts before signing.

Can I change the trust later? Yes. While you have capacity you may amend or revoke a revocable trust at any time. We prepare amendments and restatements at your direction, quoted separately.

What goes into the trust? You decide. Nevada real property is transferred by the deed we prepare and record. Accounts are retitled or the trust is named with the institution, at your instruction. Vehicles may be listed on the trust schedule; a DMV title transfer into the trust is prepared separately if you want one.

What if I own more than one property? Each additional deed is $250, plus the county recording fee.

How long does it take? Drafts are usually ready within two to three business days after we receive complete information and payment. Signing is scheduled after you have reviewed the drafts, and the Recorder's processing time follows.

Is notarization included? Notary fees are billed separately at the Nevada schedule (NRS 240.100), with mobile travel and remote online notarization priced on our notary pages.
