If you have been served with a court date in Clark County, Nevada, and you cannot physically appear at the Eighth Judicial District Court or a Las Vegas Justice Court hearing, the court rules allow you to request a telephonic appearance. The procedure is governed by Eighth Judicial District Court Rule (EDCR) 2.23 and the local justice court rules, and it requires a written motion or stipulation that the court must approve in advance. What a Telephonic Appearance Is

A telephonic appearance is permission from the court to appear at a hearing by telephone (or in many departments, by Zoom or BlueJeans) instead of in person. It is most commonly granted in civil status checks, scheduling conferences, motion hearings, short calendar matters, and certain family law non-evidentiary hearings. Evidentiary hearings, trials, and contested motions where credibility is at issue are generally not granted by phone. Each department in the Eighth Judicial District Court has its own preferences, so the request must be filed early enough for the assigned judge to rule before the hearing date.

EDCR 2.23 — The Governing Rule

EDCR 2.23 (Telephonic and Video Conference Appearances) is the rule that authorizes telephonic appearances in the Eighth Judicial District Court. The rule requires a written request with stated grounds (for example, distance, medical, work, child care, or out-of-state residence). The request must include the case caption, the date and time of the hearing, the department number, the requesting party's contact information, and the proposed method of appearance. Some departments require a stipulation if all counsel or self-represented parties agree. Las Vegas Justice Court has a parallel local rule and uses a slightly different request form. The Henderson Justice Court and North Las Vegas Justice Court also accept telephonic appearance requests under their own local rules.

Who Typically Requests a Telephonic Appearance in Clark County

Out-of-state plaintiffs and defendants in small claims, breach of contract, and landlord-tenant cases often need telephonic appearances. Self-represented litigants in family law status checks frequently request them when work or child care conflicts. Witnesses asked to appear at scheduling conferences may also request to appear by phone. Anyone who has moved out of Nevada after a case was filed, or anyone with a documented medical reason that prevents in-person attendance at the Regional Justice Center at 200 Lewis Avenue in Las Vegas, is a candidate for a telephonic appearance.

What the Request Document Must Contain

A telephonic appearance request prepared at your direction by Signature on Demand will include: the proper Clark County court caption (Eighth Judicial District Court or the appropriate justice court), the case number and department, your name and party designation, the hearing date and time, a clear statement of the relief requested, the factual grounds for the request, the proposed method (telephone, Zoom, or BlueJeans), the call-in number you will use, and a proposed order line for the judge's signature. Most departments also expect a certificate of service showing that opposing counsel or the opposing party received a copy of your request.

Filing Deadlines

Most Eighth Judicial District Court departments require the request at least seven (7) judicial days before the hearing. Some departments require ten (10). Justice courts in Clark County typically want it at least five (5) judicial days in advance. If you submit it late, the judge can deny the request and require you to appear in person, and a failure to appear can result in a default judgment in a civil case or a bench warrant in a criminal matter.
