Small Claims Paperwork in Las Vegas: A Calm, Step-by-Step Guide

The text message still sits on your phone: "I'll have it back to you by Friday." That was months ago. Maybe it was a contractor who took a deposit and stopped answering. Maybe it was a security deposit that never came back, or a friend who borrowed money and then went quiet. You have replayed the conversation a hundred times. What keeps you up at night is not the argument. It is the paperwork.

If you are in Las Vegas, Henderson, Summerlin, North Las Vegas, or Boulder City and you have decided to take a money dispute to small claims court, this guide walks through the paperwork in plain language, so you can walk in organized instead of overwhelmed.

Want the paperwork prepared the way you direct, with a notary who comes to you? Call 725-243-5188.

What Small Claims Court Handles in Clark County

Small claims cases in Nevada are governed by NRS Chapter 73. Under NRS 73.010, a justice of the peace hears small claims cases for the recovery of money only, up to a dollar limit set in that statute. Small claims court does not order someone to do something other than pay money.

Clark County has 11 justice court jurisdictions, including Las Vegas, Henderson, North Las Vegas, and Boulder City. NRS 73.010 also says where a case may be filed, such as the township where the defendant lives, does business, or is employed. Each court explains its own venue rules, and a question about which court fits your situation belongs with that court's self-help resources or a licensed Nevada attorney.

Small Claims Paperwork in Las Vegas, Piece by Piece

Every justice court publishes its own forms and instructions. The examples below come from the North Las Vegas Justice Court small claims page and its filing packet. Other townships, including Las Vegas and Henderson, publish their own versions, so always check the instructions for the court where the case will be filed.

1. The Demand Letter

The North Las Vegas Justice Court instructions describe a formal demand letter sent before filing. The letter states the exact amount and the reason for it, and says the matter will be filed in small claims court if it is not resolved within 10 business days. The court says the letter must go by certified mail, return receipt requested, and that the filing can be made 15 days after mailing.

2. The Affidavit of Complaint

The complaint itself is a sworn form called an Affidavit of Complaint. The North Las Vegas packet asks for it to be typed or written legibly in blue or black ink, and lists what goes with it:

  • The Affidavit of Complaint plus the copies the court requests

  • A copy of the demand letter

  • Proof of certified mailing and the return receipt card

  • The court's filing fee

3. Notarized, or Signed Under Penalty of Perjury?

This is the question most people never see answered. The North Las Vegas Affidavit of Complaint offers two ways to sign: in front of a notary public, who completes a "subscribed and sworn" jurat, or as an unsworn declaration under penalty of perjury, which NRS 53.045 allows in place of an affidavit in many situations. NRS 73.015 separately provides that affidavits in small claims matters may be acknowledged before a notary public appointed by the Nevada Secretary of State.

Many people still choose to sign in front of a notary for peace of mind. If you do, our mobile notary in Las Vegas can meet you at home, at work, or by remote online notarization.

4. Serving the Other Side

Filing is not the last step. The defendant has to receive a copy of the stamped complaint, which is called service of process. The North Las Vegas court lists the Constable, the Sheriff, a licensed private process server, or a non-party adult over 18 as people who may serve. Proof of service is then filed with the court by the deadline the court sets. The court notes that a case can be taken off calendar if that proof is late.

5. Getting Evidence Ready for the Hearing

The North Las Vegas instructions ask people to label every exhibit, bring three paper copies on standard letter-size paper, and save audio or video to a removable storage device. The court is direct about one thing: do not expect the judge to read texts or view photos on your phone. Print them.

If You Were the One Served

The North Las Vegas court explains that a defendant may file a counterclaim for money owed to them, which is heard together with the original claim, and that it is served on the plaintiff the same way. Court deadlines apply, so reading the court's instructions early matters.
