What a Power of Attorney Actually Does

General Power of Attorney — Grants broad authority to handle financial and legal matters. Typically ends if the principal becomes incapacitated.


Durable Power of Attorney — Remains in effect even if the principal becomes incapacitated. This is the version most commonly used for long-term planning.


Limited Power of Attorney — Grants authority for a specific transaction or time period. Commonly used in real estate transactions when one party can't be present at closing.


Healthcare Power of Attorney — Designates someone to make medical decisions on your behalf if you cannot make them yourself. Often paired with an Advance Directive.


Why Execution Matters — and Why It Has to Be Done Right


Under Nevada law (NRS 162A.220), a Power of Attorney must be either signed before a notary public OR signed by two adult witnesses. Most financial institutions, healthcare providers, and courts require notarization specifically — so while the law gives you a choice, notarization is the standard that gets accepted everywhere without question.


This is where errors are most common. A POA executed improperly — wrong acknowledgment language, a missing element in the document, or a witness who doesn't qualify — may be rejected entirely, leaving the agent with no authority to act when it's needed most.


Nevada also has specific requirements for what must appear in the document itself: the principal's identification, the scope of authority granted, and the proper execution language. If any of those elements are missing or incorrect, the document may not hold up when it matters.


And here's the detail that catches people off guard: if a person becomes incapacitated before a POA is signed, it's too late. At that point, the family may have no choice but to pursue a Nevada guardianship proceeding — a court process that can take months and cost thousands of dollars. A properly executed POA, done now, eliminates that risk entirely.
