How a Joint Petition for Divorce Works in Nevada - Documents, Timeline & Resident Witness

A joint petition for divorce is the fastest, least expensive path to ending a marriage in Nevada when both spouses agree on every term. Filed correctly, it can be signed by a judge within a few weeks of submission, without either spouse setting foot in a courtroom. What a Joint Petition for Divorce Is

A joint petition is a single court filing signed by both spouses that tells the judge they've already agreed on everything the divorce needs to resolve: property division, debt division, spousal support if any, child custody and visitation if there are children, child support, and whether either spouse will return to a former name. Because the agreement is already complete on paper, the judge usually signs the decree without scheduling a hearing.

This is procedurally different from a Complaint for Divorce, which one spouse files against the other when they don't agree on terms. A Complaint requires service of process on the other spouse, a 21-day response window, and often a hearing or trial. A joint petition skips all of that - both spouses sign and the case is treated as resolved from the start.

For couples who genuinely agree on the terms, the joint petition usually finalizes in one to three weeks once filed. Who Qualifies in Nevada

Two conditions have to be met before a Nevada court will accept a joint petition. At least one of the two spouses has to have lived in Nevada for at least six weeks before the filing. And both spouses have to genuinely agree that the marriage is incompatible and on every term the petition resolves.

The six-week residency requirement is documented on a separate paper called the Affidavit of Resident Witness. A friend, family member, or neighbor who also lives in Nevada signs this affidavit confirming they personally know the petitioning spouse has lived in Nevada for at least six weeks and intends to remain. Without the affidavit, the joint petition won't be accepted.

The Documents in a Nevada Joint Petition Package

A complete joint petition package filed in Clark County typically includes a Family Court Cover Sheet, the Joint Petition for Divorce itself, the Affidavit of Resident Witness, a Decree of Divorce drafted for the judge to sign, a Property Settlement Agreement listing how assets and debts are divided, and - if the marriage produced children - a Child Welfare and Identification Sheet plus a parenting plan and child support agreement. If the divorce divides a retirement account such as a 401(k), pension, or IRA, a Qualified Domestic Relations Order (QDRO) is prepared separately.

Both spouses sign the petition in front of a notary. That last step - the in-person signing of a sworn document - is often where a mobile notary in Las Vegas saves a weekday morning by coming to the home or office instead of asking both spouses to meet at a bank or shipping store.
