Choosing the Right Henderson Eviction Notice
Nevada has several types of eviction notices, each tied to a specific NRS section. The 7-Day Notice to Pay Rent or Quit (NRS 40.253) is for nonpayment of rent. The 5-Day Notice for Unlawful Detainer (NRS 40.254) is for tenants holding over after the lease ended or after a no-cause notice expired. The 30-Day No-Cause Notice (NRS 40.251) is for month-to-month tenants when the landlord wants the unit back without alleging fault. The 60-Day No-Cause Notice (NRS 40.251) applies to month-to-month tenants who have rented for more than one year. The 5-Day Notice to Quit for Nuisance, Waste, Assignment, or Unlawful Use (NRS 40.2514) is used for serious lease violations. There is also a 3-Day Notice to Perform Lease Condition or Quit (NRS 40.2516) for curable lease violations.
Henderson-Specific Service Requirements
Service of the eviction notice must be by personal delivery, by leaving the notice with a person of suitable age at the rental unit AND mailing a copy, or by posting on the door of the unit AND mailing a copy if the tenant cannot be found. NRS 40.280 sets out the proof-of-service requirements. The Henderson Justice Court will not accept the case unless the notice was served correctly and the affidavit of service is filed. Calculating the Notice Period in Henderson
Day counting matters. Under NRS 40.400 and the rules of computation, the day the notice is served is not counted; counting begins the next day. Saturdays, Sundays, and legal holidays are generally counted, but if the last day falls on a Saturday, Sunday, or holiday, the period extends to the next business day. A 7-day pay-or-quit served on a Wednesday means the tenant has through end of day the following Wednesday to pay. Get the calendar wrong and the tenant can move to dismiss the unlawful detainer complaint. What Happens After the Notice Expires
If the tenant has not cured the default or vacated by the deadline, the next step is filing a Complaint for Summary Eviction in the Henderson Justice Court (for non-pay-rent or 5-day unlawful detainer cases) or a Complaint for Unlawful Detainer in district court for more complex matters. Summary eviction is the faster track in Nevada justice courts. The complaint must include a copy of the notice that was served, the affidavit of service, the lease (if any), and the supporting documentation. Tenant Response and the Show Cause Hearing
After the complaint is filed and the tenant is served, the tenant has a window to respond — typically a written affidavit or answer in summary eviction cases. If the tenant files a response, the Henderson Justice Court schedules a show cause hearing, usually within seven (7) judicial days. If the tenant does not respond by the deadline, the landlord can ask the court to issue an order for summary eviction. The constable or sheriff then serves the order and conducts the lockout once the timing requirements in NRS 40.253 and NRS 40.254 are satisfied.
Common Henderson Eviction Mistakes That Cause Dismissal
Wrong NRS citation on the notice. Wrong number of days for the tenant's tenure (the 30-day vs. 60-day distinction at the one-year mark). Failure to mail the second copy when the notice was served by leaving and mailing or posting and mailing. Missing or incomplete affidavit of service. Accepting partial rent during the notice period (which can waive the eviction). Filing in the wrong court when the rental property is outside the Henderson Justice Court boundaries. Each of these is preventable with a properly prepared notice and a clean filing packet.
